Governor Greg Gianforte signed a measure to ban the Tiktok app in the state of Montana, one month after it was approved by the state assembly; the law is expected to go into effect in 2024, but legal challenges might potentially postpone that date.
TikTok's users won't be punished for using the service, but app stores and the company itself risk daily fines of $10,000 for breaking the law, which forbids the company from functioning in the state and forces them to prevent consumers in Montana from installing the app.
The statewide ban, along with the anticipated legal challenge to it, provides a glimpse of how other attempts to outlaw the app would proceed across the nation. A spokeswoman for TikTok claimed in a statement that the Montana law "unlawfully" infringes on the First Amendment rights of its users.
"Governor Gianforte has signed a bill that unlawfully forbids TikTok, a platform that empowers hundreds of thousands of people throughout the state, violating the First Amendment rights of the people of Montana," the spokesperson claimed. "As we continue to work to defend the rights of our users both inside and outside of Montana, we want to reassure Montanans that they can continue to use TikTok to express themselves, make a living, and find community."
Legislators from Montana have asserted, like other politicians who have called for bans or limitations on TikTok, that the app's connections to the Chinese corporation ByteDance endanger the privacy of US users. In order to satisfy data security concerns expressed by US regulators, the business has long denied that it would provide such data to the Chinese government and has put more than $1 billion into Project Texas.
However, according to officials, those initiatives fall short, and the US government is currently attempting to pressure ByteDance to sell TikTok. If not, TikTok will likely be subject to a national ban and a protracted court battle.
